European court for human Rights orders France told to recognise kids born to surrogates

This is great news and so much appreciated,we have a couple of French patients from the past who would very much appreciate this ruling and so many Prospective commissioning parents willing to enrol in our Surrogacy Program but we cant take them because their Government will not give  aletter endorsing Surrogacy.
"The European Court of Human Rights (ECHR) ruled France must allow families to officially register the birth of babies born abroad to surrogate mothers, which would then pave the way for the children to become French citizens.

The court  ruled that by refusing to officially recognize the children France was undermining their identity within French society.

Thursday's verdict is linked to a case brought by two sets of French parents who hired surrogates in the United States, where surrogacy is legal in some states, and had children by them.

The Mennessons had twins daughters through a surrogate in California in 2000, while the Labassees had their daughter via proxy in 2001. All three of the children are American citizens.

Under usual circumstances, a child born abroad to French parents would automatically be granted French citizenship, but in the case of the two couples, authorities refused to recognize the couples’ position as parents to the children because they were born to surrogates. Meaning the children still haven't been granted French citizenship.

The European court ruled however that although these parents didn’t give birth to their children, they “live together in way that doesn’t distinguish their family life from its usual meaning.”

While Dominique Mennesson said the verdict was a "great relief", her lawyer Patrice Spinosi, told French daily Le Figaro the case could impact on thousands of children.

"In the eyes of French law, these children have no parents, not even the father who is raising them," said Spinosi. "Two thousand children in France are in the same situation as the Mennesson girls."

Vietnam legalises Surrogacy with a 60% vote

in Vietnam the National Assembly deputies voted on the specific contents on surrogacy. It was approved with 59.1 percent of the vote. The ballot was held because the surrogacy content had been protested by many deputies.

A GAY couple from Danbury will be propelled into the nation’s living rooms this Monday when a TV series about their surrogacy company begins.
Barrie, 43, and Tony Drewitt-Barlow, 49, hit the headlines in 2000 when they became Britain’s first gay surrogate parents. They now have five children and are considered ‘the most famous gay dads in the country’.
Since their first child, the couple have set up their own surrogacy company – the British Surrogate Centre – to help other couples throughout Europe have a child.
The show will follow the trials and tribulations of the company, highlighting the good times and the tearful times. It was the brainchild of fellow Essex lad David Van Day, former member of band Guys’n’Dolls.

Busy busy busy-i love being busy with work!!

Oh Boy!! has it been a busy week or what!!!
so many babies born in the last one week.
first the Coldren's from USA had twins in the first week of march and then a couple of weeks ago a UK based couple Lee and Matt had their twins as well,these two were born premature and a lot of time was spent in consultation with the paediatricians to ensure that no complications developed.
thankfully they are doing fine now and will be recover fast,fingers crossed and a prayer on the lips for them.
Today Manel From Spain was blessed with a baby girl and so were Mrs and Mr.yang from canada.
April/may has been all about girl power.the number of girls born were siginifcantly higher than boys.
all the babies and their Surrogate mommies are doing fine..
its not just the clinical work and the work in the ivf lab that keeps me busy,since the change in regulations i have to work closely with both the Singh's to make sure that the paperwork for the medical visas/Surrogacy visas is updated from time to time and given to commissioning parents on time.all embassies across the world are not yet full in tune with the process especially because they outsource the paper work and hence someone or the other comes up with a new checklist every now and then and this keeps the lads on their toes all the time!!
right now it feels like the medical part is the easy part and the paperwork required for babies born through surrogacy especially for some countries such as the UK is simply ridiculous!!
we realise the importance of the surrogacy journey and we also realise that no two sets of commissioning parents will be the same,so we always make sure that we dont drop the ball when it comes to the paper work because this is extremely vital.

surrogacy law in relation to Ireland

The Irish Govt. Intends to modernise Ireland’s “substantially outdated” laws on the care and upbringing of children during 2014.
The proposed laws will also cover the legal status of children in civil partnerships, surrogacy arrangements and assisted human reproduction.
According to a recent briefing note published by the Department of Justice, the Bill will provide for a “contemporary legal architecture on guardianship, custody, access and the upbringing of children in diverse family forms”.
This will include married families, families that rely on the care of children by relatives, families based on cohabiting couples and civil partnerships.
Surrogacy
The department says that there is a growing concern around the practice of commercial surrogacy in Ireland and the use of international commercial surrogacy by Irish people.
This has “very serious implications” for the birth registration of children in Ireland, as well as concerns relating to the possible exploitation of people involved in the arrangements.
A number of cases related to surrogacy have already made their way to the Irish courts with the Supreme Court to hear another early next year.
When enacted, the Bill will permit non-commercial surrogacy arrangements. At the same time, it will prohibit people or agencies from advertising surrogacy services. It will also be illegal to try and persuade a woman to act as a surrogate.
Under the legislation, it will be an offence for a person to receive payment for making or facilitating a surrogacy or advertising surrogacy arrangements.
The reimbursement of “reasonable” surrogacy costs, including medical bills, travel, accommodation and loss of earnings, can only be enforced where an arrangement was put in place before conceptions.
The laws will mean that parentage of a child can be legally assigned by the court on the basis of genetic connection to one of the intending parents and the spouse, civil partner or cohabiting partner of that person.
The consent of any surrogate will be essential. If that consent is not given, she will be the legal mother of the child if she does not consent to the application.
Parentage can be declared by the court when the child is born in the State or the alleged parent ordinarily resides here.
The bill will oblige parties to an arrangement to obtain legal advice before conception.

The Assisted Reproductive Technology Procedures (ART)

How to Begin an IVF Cycle?

An IVF patient should call advanced fertility services on day 1 or 2 of her period. A nurse or a doctor will relay instructions as to when to come to the office for the first IVF visit and at which time she will receive instructions regarding her specific treatment plan. The second visit of protocol treatment is started on day 20th of the menstrual cycle.

IVF Medications

Each patient's medication plan is individualized, but most IVF regimens include one or more of the following:

GnRH Agonist

GnRH Agonist is used to help create equally mature eggs. Some statistics indicate that these drugs GnRH Agonist may be associated with higher success rates and lower IVF cycle cancellation rates. GnRH Agonist is usually started on Day 21 of the patient's previous cycle and is injected subconsciously (under the skin). However, in some instances, GnRH Agonist may be started on cycle Day 2.

HMG / FSH / LH

HMG (Human Menopausal Gonadotropin), which consists of 75 units of FSH (Follicle Stimulating Hormone) and LH (Luteinizing Hormone), is administered by intramuscular (into the muscle) injection and is usually given in the evening or morning. Some of the patients will receive pure FSH or Recombinant FSH.

Recombinant FSH (no trade name as of yet)

This ultra-pure FSH product, currently available in India, is made by genetic engineering. From a treatment point of view, it will be similar to pure FSH in all respects. A KIC staff member will teach the patient and her partner to reconstitute the different medications and administer the injections at their places from a doctor, if the patient is from out- of- station. Most of the patients and their partners have little trouble getting used to the shots. Placing an ice-pack on the injection site, before and after the injection is given, will help reduce any related discomfort. Patients must have their visit between 10:00 AM to 4:30 PM on weekdays and from 11:00 AM to 12:30 AM on Sundays to ensure consultation with the infertility specialist.

Patient Monitoring

Patients are usually asked to come in to KIC for blood tests and sonograms to determine the maturity of their developing eggs beginning on cycle Day 3, 5, 7 or 9. Further monitoring will be carried out as needed until the eggs are determined to be mature. Occasionally, some patients will need to be monitored on a daily basis near the end of the ovarian stimulation phase of the cycle.

Blood Tests

Patients usually receive 2 or 3 blood tests during the course of the monitoring process: Estradiol (Estrogen) and Progesterone. Estradiol allows us to approximate the relative maturity of the eggs. Generally, the tests will show between 100 and 200 units of estrogen for every matured egg. Progesterone tells us if the eggs are becoming overripe, the patient's progesterone level, which depends on the number of egg follicles created, should be below 2 units.

Sonograms

The maturity of the follicles developing in the ovaries is monitored via vaginal ultrasound. During this painless procedure, a Sonographer inserts a small probe into the vagina. This enables her to visualize the ovaries and the uterus, to evaluate the maturity of the Endometrium (the inner lining of the uterus), and to count and measure the follicles developing in each ovary. A mature follicle measures from 16 to 22 millimeters. An Advance technology of Color Doppler study is used at KIC to monitor the blood in the follicle and Endometrium.

The Final Step to Egg Maturation

When blood tests and sonograms indicate that the eggs are mature, the patient will be instructed to administer a final injection called HCG (Pregnyl, Profasi) to complete the maturation of the egg. The HCG shot must be taken at KIC, (Hyderabad) between 9:30 PM and 11:00 PM on the date specified, and the retrieval will be scheduled for some 30-34 hours after the HCG injection. For example, if a patient's Monday monitoring showed her follicles to be of the appropriate size and her estrogen levels were found to correlate with maturity, she would be instructed to take her HCG between 9:00 PM and 11:00 PM Monday evening. Her egg retrieval will then be performed on Wednesday morning.
The timing of the retrieval after the HCG injection is critical, since HCG may cause the egg follicles to release prematurely, making IVF retrieval impossible. Fortunately, this rarely happens.

Before the Procedure

The patient will be instructed not to eat solid foods after midnight, prior to the procedure. It is advisable to abstain from sexual activity for two days prior to the procedure to ensure the highest possible sperm count from the male.

What are the chances of success with IVF?

Here at Kiran Infertility Center (P) Ltd, the Overall Delivery Rate Per Egg retrieval until now was 41.33%%. Now with the advent of newer drugs & protocols, the Clinical Pregnancy Rate Per Egg Retrieval for 2009-10 was 45.33%. Our ongoing pregnancy rate for 2009-10 is 38.9%(CONFIRMED HEART BEAT/CYCLE).

FOR 3 CYCLES OUR CUMULATIVE PREGNANCY RATES ARE AS HIGH AS 90%.

The specific chance of success varies with a number of factors including the indication for the procedure, the patient's age, the number of embryos transferred and a variety of other factors. Your chances of success with IVF will be discussed on an individual basis with your physician. The success rate with IVF must be viewed considering the natural fertility rate in fertile couples that is approximately only 15% per month. We advise you to undergo a package of at least 3 cycles, so that finally we can ensure you at least 85-90% success rate. Appropriate concessions are given in the financial aspect of treatment if you undertake this type of package.
