The surrogacy (Regulation) Act – 2021 has failed to bring relief to same sex couples, single men and transgender who are longing for raising their family through fertility treatment or surrogacy.
According to Dr. Samit Sekhar of Kiran Infertility Centre – Hyderabad, the present surrogacy (Regulation) Act is a restrictive law that discriminates same sex couples, single men and trans-genders for having a baby through fertility treatments such as surrogacy.
He further provides instances of countries
like Israel, Thailand where surrogacy is open for all its citizens irrespective
of being same sex couples, transgender looking forward to have baby through
fertility treatment which is not just restricted to heterosexual couples.
